In February, the Council of the European Union released the final text for EMIR 3.0 with the expectation that this will be published in the Official Journal once approved by the EU Parliament. The final text amends existing rules and introduces new provisions such as active accounts, authorisation and validation of initial margin models, and multiple reporting and transparency requirements around margin management in cleared transactions.
While the details of the new requirements remain unclear until determined by the Regulatory Technical Standards set out by ESMA, derivatives participants can start to gain a better understanding of the EMIR 3.0 provisions and how they may impact derivatives clearing and post-trade processes.
